About This Service

A registered trademark gives you the exclusive statutory right to use your brand name, logo, or tagline for the goods and services you have registered, and the ability to stop others from using a confusingly similar mark. Marks are filed under the Nice Classification which divides all goods and services into forty-five classes, and protection extends only to the classes you file in. Frequently Asked Questions

How long does trademark registration take?

Typically 12 to 24 months if unopposed. You can use the ™ symbol from the date of filing, and the ® symbol only after registration is granted.

What are the government fees?

₹4,500 per class for e-filing by an individual, startup, or MSME, and ₹9,000 per class for other applicants. An Udyam certificate is what qualifies you for the lower rate, so it is worth registering first.

How long does protection last?

Ten years from the filing date, renewable indefinitely in ten-year blocks. A renewal application can be filed up to six months before expiry.

What if my application receives an objection?

The examiner issues an examination report, usually citing a similar existing mark or a descriptiveness ground. We draft and file a reply, and attend a hearing if one is scheduled. Many objections are successfully overcome.

Can I trademark a common or descriptive word?

Purely descriptive words are difficult to register on their own. A distinctive logo treatment, an invented word, or a word that has acquired distinctiveness through long use has a much better chance.
